How Georgia’s Panel of Physicians Works in Workers’ Compensation Cases (and What Injured Employees Should Know)
David Garner
Quick Summary:
After a work injury in Georgia, you usually must
start treatment with a doctor listed on your employer’s official “panel of physicians.” But you still have the right to choose which
doctor on that list you see. If the panel is invalid, missing, unreadable, or not properly posted, you may gain the right to choose your own doctor—including one not
controlled by the insurance company. Many injured workers from Dallas, Hiram, Carrollton, Douglasville, Rome, and across West Georgia don’t realize how much control they actually have.
What Is Georgia’s “Panel of Physicians”?
Under Georgia workers’ compensation law, most employers are required to post a clearly visible list of approved medical providers, known as a panel of physicians. This panel determines which doctors you can choose from when you’re hurt on the job.
A valid, lawful panel must include:
- At least six (6) doctors
- No more than two industrial clinics(like Concentra or Caduceus)
- At least one orthopedic specialist
- A list that is posted where employees can easily see it(breakroom, time clock, bulletin board, etc.)
- A list that is accurate and up to date
If your employer does not meet these requirements, the panel may be considered invalid—and your rights may expand significantly.
If the Panel Is Valid, What Are Your Rights?
If your employer’s panel meets all legal requirements, you still have important choices. You may:
- Choose any doctor on the panel as your authorized treating physician (ATP)
- Switch to another doctor on the panel one time without needing permission
- Receive referrals to specialists from your ATP (without needing to choose from the panel again)
Even with a valid panel, the insurance company does not
get to choose your doctor for you. You have the right to pick the doctor you trust the most.
If No Panel (or an Invalid Panel) Exists, Your Rights Change
This is where many West Georgia workers—from Carrollton to Douglasville to Rome—discover they have far more power than they realized. If the employer never properly posted a panel, or posted one that doesn’t follow the rules, you may be legally entitled to choose any doctor you want. That may include your own primary care doctor or an injured-worker-friendly specialist.
Common issues that make a panel invalid include:
- Only listing 3–4 doctors instead of six
- Listing multiple clinics owned by the same corporate chain
- Panel posted in a locked office where employees never see it
- Doctors who have moved, retired, or no longer take workers’ comp cases
If any of these problems exist, the insurance company cannot force you back to their clinic.
When You Can Change Doctors
You generally get one free change
to another provider on the panel. You do not need your employer’s permission—you simply need to notify them that you’ve selected another listed doctor.
You may also request a change through the Georgia State Board of Workers’ Compensation if:
- Your doctor isn’t listening to you
- Your treatment isn’t helping
- Your doctor won’t order an MRI or specialist referral
- You feel rushed or dismissed
If the panel is invalid, you may not be limited to panel doctors at all.
Common Traps Injured Workers Fall Into
At Garner Law Office in Dallas, GA, we regularly help injured workers who unknowingly lost important rights early in their case because they didn’t understand the panel. Here are some of the most common mistakes:
- Letting the employer send you to the first clinic they choose. You are allowed to review the panel and choose for yourself.
- Believing the clinic doctor works for you. Many first-clinic providers work closely with employers and insurers—not injured employees.
- Assuming you can’t change doctors. Georgia law gives you that right.
- Not checking whether the panel is even valid. Many aren’t.
If you feel stuck with a doctor who minimizes your symptoms or pushes you back to work too soon, you’re not alone—and you may have options.
